These Terms of Use ("Terms") govern your use of the Caller Name Talker & Alert mobile application ("the App"), package com.callalert.flash.announcer, provided by the developer of Caller Name Talker & Alert ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License Grant
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Android devices that you own or control, for your personal, non-commercial use, and in accordance with these Terms and the Google Play Terms of Service.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. By using the App you represent that you meet this requirement.
3. The App Is Free and Ad-Supported
The App is provided free of charge and is supported by advertising served through third-party SDKs (including Google AdMob). The App does not currently offer paid subscriptions or in-app purchases. Where required by law, the App will request your consent before serving personalized ads. Your use of advertising and analytics features is also described in our Privacy Policy.
4. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the App, except to the extent permitted by law.
- Copy, resell, sublicense, rent, or otherwise commercially exploit the App.
- Use the App to violate any law, or to intercept, record, or misuse communications you are not authorized to access.
- Circumvent, disable, or interfere with security or advertising features of the App.
5. Your Device & Content
The App reads incoming call, contact, and message information on your device to provide its announcement features, as described in the Privacy Policy. You are responsible for how you use these features and for complying with applicable laws in your jurisdiction (including laws about recording or announcing communications). You retain ownership of any data on your device.
6. Disclaimers
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that announcements will always be timely or accurate. Do not rely on the App for emergencies or safety-critical situations.
7. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Because the App is provided free of charge, our total aggregate liability to you for any claim relating to the App shall not exceed USD 10.
8. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising out of your use of the App or your violation of these Terms or applicable law.
9. Termination
These Terms remain in effect while you use the App. You may terminate them at any time by uninstalling the App. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
10. Google Play Distribution
The App is distributed through Google Play. This agreement is between you and the developer of the App only, and not with Google. Google is not responsible for the App or its content. Your use of the App must also comply with the Google Play Terms of Service and the Google Privacy Policy. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list, and you will comply with applicable export control laws.
11. Governing Law
These Terms are governed by the laws applicable at the developer's principal place of business, without regard to conflict-of-laws rules. Mandatory consumer-protection rights in your country of residence remain unaffected.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above and, where appropriate, announced in-app or in the Google Play release notes. Continued use of the App after changes means you accept the updated Terms.
